By accessing or using the EdiMono platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
EdiMono provides a cloud-based energy management platform that enables users to import utility data, analyze building energy performance, generate weather-normalized baselines, and produce measurement and verification (M&V) reports. The Service includes web-based dashboards, data analytics, reporting tools, and API access as described in your subscription plan.
You are responsible for:
You retain all ownership rights to the data you upload to EdiMono ("Your Data"). We do not claim ownership of Your Data. We use Your Data solely to provide and improve the Service as described in our Privacy Policy.
You grant us a limited, non-exclusive license to process, store, and display Your Data as necessary to provide the Service. This license terminates when you delete Your Data or close your account.
You agree not to:
Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as explicitly stated in your service agreement.
We reserve the right to modify pricing with 30 days' notice. Price changes will take effect at the start of the next billing cycle following the notice period.
We strive to maintain 99.9% uptime for the Service. Planned maintenance windows will be communicated in advance. We are not liable for service interruptions caused by factors outside our reasonable control, including internet disruptions, third-party service outages, or force majeure events.
The Service, including its design, features, code, documentation, and branding, is owned by EdiMono and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
To the maximum extent permitted by law, EdiMono shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for all claims arising from these Terms shall not exceed the amount paid by you to EdiMono in the twelve (12) months preceding the claim.
Either party may terminate these Terms at any time. Upon termination, your right to use the Service ceases immediately. You may export Your Data for up to 30 days following termination, after which it will be permanently deleted in accordance with our data retention policy.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Montreal, Quebec.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
